Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") defines the permitted and prohibited uses of the Ensoul platform, APIs, SDKs, and related services (the "Service") provided by Ensoul LLC ("Ensoul," "we," "us," or "our"). This AUP is incorporated into and forms part of our Terms of Service.

We believe AI-powered synthetic personas can create tremendous value across research, education, gaming, training, and creative applications. This AUP ensures those capabilities are used responsibly and ethically.

2. General Rules

When using the Service, you must:

  • Comply with all applicable laws and regulations
  • Respect the rights and dignity of others
  • Accurately represent the nature of AI-generated content when deploying personas in public-facing contexts
  • Implement appropriate safeguards when deploying personas in sensitive contexts (healthcare, education, vulnerable populations)
  • Maintain the security of your account credentials and API keys

3. Prohibited Uses

You may not use the Service for any of the following purposes. This list is not exhaustive; Ensoul reserves the right to determine whether a use violates this AUP.

3.1 Harmful Content

  • Generating content that promotes violence, terrorism, self-harm, or hatred against any individual or group
  • Creating content that sexualizes minors in any way
  • Generating content designed to harass, bully, threaten, or intimidate individuals
  • Producing content that promotes illegal activities or provides instructions for committing crimes

3.2 Deception and Impersonation

  • Impersonation: Creating personas that impersonate specific real individuals without their explicit consent, particularly for the purpose of deception, defamation, or fraud. This includes violating voice and likeness rights protected under state laws such as the Tennessee ELVIS Act.
  • Deepfakes and synthetic media: Using the Service to generate deceptive synthetic media (text, audio scripts, or behavioral profiles) intended to mislead people into believing the content was produced by or represents a real person. Note: The federal TAKE IT DOWN Act (2025) criminalizes non-consensual intimate deepfakes, and the DEFIANCE Act (2026) establishes a federal right of action for victims.
  • Undisclosed AI interaction: Deploying personas in contexts where users reasonably believe they are interacting with a real human, without clear disclosure that the interaction is AI-generated
  • Misinformation: Using personas to deliberately generate or spread false or misleading information
  • Fake reviews or testimonials: Using personas to generate fake reviews, testimonials, social media posts, or other content intended to deceive consumers. This may also violate FTC guidance on AI-generated endorsements.

3.3 Privacy Violations

  • Inputting personal data of real individuals into persona definitions without a lawful basis and appropriate consent
  • Using the Service to profile, surveil, or track real individuals
  • Attempting to re-identify individuals from de-identified or anonymized data using personas
  • Scraping personal data from external sources to create personas based on real people

3.4 Security and Infrastructure Abuse

  • Attempting to gain unauthorized access to the Service, other accounts, or related systems
  • Interfering with or disrupting the Service infrastructure, including denial-of-service attacks
  • Reverse-engineering, decompiling, or attempting to extract the source code or underlying algorithms of the Service
  • Using automated tools to scrape, crawl, or mine data from the Service beyond approved API usage
  • Circumventing rate limits, usage quotas, or other technical restrictions
  • Sharing, selling, or transferring API keys or account access to unauthorized parties

3.5 Commercial Misuse

  • Reselling or sublicensing the Service without Ensoul's written consent
  • Using the Service to build a competing product or service
  • Using the Service to generate training data for competing AI models
  • Misrepresenting AI-generated output as human-created work in commercial contexts where the distinction is material

3.6 High-Risk Uses Without Safeguards

The following uses are permitted only with appropriate safeguards, human oversight, and compliance with applicable regulations. These use cases may trigger additional legal obligations under the EU AI Act, Colorado AI Act, or other AI-specific legislation:

  • Healthcare applications (personas must not provide medical advice without qualified human review)
  • Legal or financial applications (personas must not provide legal or financial advice without qualified human review)
  • Applications involving vulnerable populations (children, elderly, individuals with mental health conditions)
  • Educational assessments or credentialing where persona output could affect student outcomes
  • Decision-making systems that materially affect individuals' rights or opportunities
  • Employment decisions: Using personas to screen, evaluate, or make hiring, promotion, or termination decisions about real individuals. Note: NYC Local Law 144 requires annual bias audits for automated employment decision tools; Illinois HB 3773 (effective 2026) prohibits AI-based employment discrimination; the Colorado AI Act classifies employment AI as high-risk
  • Insurance underwriting, credit scoring, or housing decisions where persona outputs influence real-world outcomes for identifiable individuals

4. Permitted Uses

The Service is designed for a wide range of legitimate applications, including but not limited to:

  • Academic research: Social science, psychology, behavioral studies, and survey simulation
  • Game development: NPC characters, interactive storytelling, and world-building
  • Corporate training: Role-play scenarios, communication skills development, and diversity training
  • Product research: Market research, user persona modeling, and focus group simulation
  • Healthcare simulation: Patient communication training, clinical scenario modeling (with appropriate safeguards)
  • Creative applications: Interactive fiction, character development, and narrative exploration
  • Testing and QA: Generating diverse user personas for application testing

5. Research Exception

Ensoul recognizes the importance of academic and scientific research, including research that may involve studying sensitive topics (e.g., misinformation, radicalization, bias). Bona fide research activities conducted under IRB approval or equivalent ethical oversight may be granted exceptions to specific provisions of this AUP, subject to:

  • Prior written approval from Ensoul
  • Documentation of ethical review and approval
  • Appropriate data handling and security measures
  • Agreement not to publish or disseminate generated content in ways that could cause harm

6. Enforcement

Ensoul monitors for AUP violations and may take the following actions in response to violations, at our sole discretion:

  • Warning: Written notice of the violation with a request to cease the prohibited activity
  • Content removal: Removal of content or personas that violate this AUP
  • Suspension: Temporary suspension of account access pending investigation
  • Termination: Permanent termination of the account for severe or repeated violations
  • Legal action: Pursuit of legal remedies where violations involve illegal activity or cause material harm

Ensoul will, where practical, provide notice before taking enforcement action and give you an opportunity to address the violation. However, we reserve the right to take immediate action without notice for violations that pose a risk of harm, legal liability, or damage to the Service.

Enforcement decisions are final but may be appealed by contacting support@ensoul-ai.com with a written explanation.

7. Reporting Violations

If you become aware of any use of the Service that violates this AUP, please report it to support@ensoul-ai.com. Include as much detail as possible, including the nature of the violation, any relevant URLs or account identifiers, and supporting evidence. We investigate all reports and will respond in a timely manner.

8. Changes to This Policy

We may update this Acceptable Use Policy to address new use cases, threats, or regulatory requirements. Material changes will be communicated with 30 days' notice through the Service or by email. The "Last updated" date at the top of this page indicates the most recent revision. Continued use of the Service after changes constitutes acceptance of the updated AUP.
